Personal Information Collection

EmpInfo may collect personal information when you register with us, when you use our products or services, and when you respond to our polls, surveys, e-mail messages, and newsletters, if any. When you register to use our products or services we may collect personal information including: your name, age, email address, employer, organization, occupation, date of birth, number of dependents, health insurance information (excluding all Personal Health Information), social security number, passport and visa information, Employment Identification Number (“EIN”) salary and employment history, credit card number, card verification value, the billing address, and shipping address. The types and amount of personal information collected for these activities will vary depending on the activity. For example, third party verifiers (the “Verifiers”) will be required to register and submit their credit card information and EIN so that we can, among other things, safeguard against fraudulent use of the system and authenticate their identity, whereas individuals who desire to use the system to review their own employment history (and personal information on our system) will not be required to provide any credit card information.

No personal information of any kind will ever be collected without prior consent from the employees and/or their employers, who provide us information solely for the purpose of employment verifications.

EmpInfo will not collect Personal Health Information, as that term is defined under the Health Insurance Portability and Accountability Act (“HIPAA”), nor will we collect personally identifiable information from children under 13 without prior and direct parental consent pursuant to the Children’s Online Privacy Protection Act (“COPPA”). In the event that any third party attempts to transmit or submit Personal Health Information under HIPAA or personally identifiable information under COPPA to EmpInfo, the information will be immediately “dumped” pursuant to EmpInfo’s automated systems designed specifically to delete this information before it is collected, viewed, or used in any way. We do everything we can to protect your privacy.

Non-personal Information Collection

EmpInfo also gathers non-personal information through aggregated tracking information derived mainly by tallying page views throughout our sites. This non-personal information collected includes click-throughs, IP addresses, and site and usage data. This non-personal information allows us to better tailor our content to site users’ needs.

Information Use

We use the information collected in various ways:

First and foremost, we use the information we collect to facilitate employment and salary verification checks conducted by Verifiers at the express request of employees;
Second, the next time you use our service and enter your User ID and Password, we may call up your information from our database to allow us to customize your interaction with our service.
Third, we may email to you special advertisements, offers, and notices. You may choose to opt-out of receiving these special advertisements, offers, and notices.
Fourth, we use the information you provide to facilitate product and content development, improve our services, conduct research, and provide anonymous reporting for internal and external clients; and
Fifth, we do aggregate information about how our service is used to be able to improve our service and make it more responsive to our users’ preferences.

Information Sharing and Disclosure

After receiving your prior written consent, we may share your personal information collected on this website with Verifiers so that they may conduct employment verification checks on employees. Your personal information will not be shared with any other third party, and will never be shared with Verifiers without your prior written consent and active participation in the process.

EmpInfo will collect EIN and credit card information from Verifiers to authenticate a Verifier’s identification. We will not share your personal information with Verifiers until and unless we receive your prior written consent. In addition, we will provide you with the opportunity to opt-out of the sharing of your personal information to the extent set forth in the “Opt-In / Opt-Out” section below. In addition, we will not provide access to your personal information to any third party other than Verifiers (and, of course, your current and former Employers, who already have your information). If you seek to have your personal, employment, or salary information removed from your Employer’s records, or if you believe that your Employer has unlawfully retained or transmitted to us your personal, employment, or salary information, you should contact your Employer directly. Please also be advised that your Employer can only view the personal, employment, and salary information of its own employees (or former employees), and under no circumstances can they view the records of employees of other employers.

As a reminder, we only share your personal information with Verifiers so that they may conduct employment and salary history verifications. In addition, your personal information is shared with Verifiers only after we receive your written consent instructing us to do so.

Each Employer who transmits or authorizes a transmission of personal, employment, and salary information to EmpInfo represents and warrants that they have the authority and have obtained all necessary consents from Employees to transmit or authorize to transmit such information to EmpInfo. From time to time, we may offer services that allow you to log in to our website(s) by using third-party log in mechanisms. In these instances, you will remain bound and obligated to follow the terms, conditions, rules, and regulations of those third party service providers. EmpInfo may share aggregate information about our customers with third parties. This aggregate information will not be tied to a user’s personal information. Except as noted above, EmpInfo does not share personal information about site users with third parties, other than Verifiers, unless doing so is appropriate to carry out a user’s request or it reasonably believes that doing so is legally required or is in EmpInfo’s interest to protect its property or other legal rights or the rights or property of others.

Legal Basis for Processing

We process personal data based on one or more legal grounds, including:
• Consent: When consumers provide consent for specific processing activities.
• Contractual Necessity: When processing is necessary to fulfill our contractual obligations with consumers.
• Legal Obligations: When processing is necessary to comply with legal obligations.
• Legitimate Interests: When processing is necessary for our legitimate interests, provided that such interests are not overridden by the rights and freedoms of consumers.

Data Rights

Under applicable data protection laws, consumers have certain rights regarding their personal data, including:
• Right to Access: Consumers have the right to request access to their personal data and information about how we process it.
• Right to Rectification: Consumers have the right to request correction of inaccurate or incomplete personal data.

• Right to Non-Discrimination: Consumers have the right not to be discriminated against for exercising their rights under applicable data protection laws.
• CCPA-Specific Rights: California residents have additional rights under the CCPA, including the right to opt out of the sale of their personal information and the right to request the deletion of their personal information.

Opt-In/Opt-Out

Employers, Verifiers, and Employees (any one of which is a “User”) have the option to enroll and cancel their accounts at any time. Once accounts are canceled, Users will have no opportunity of any kind to view any information of any kind that resides or ever resided on our system.

Notwithstanding the foregoing, Employees have the option to opt-out by completing a form withdrawing their consent for EmpInfo to release their income/salary information, opt-out of which is expressly limited to those Verifiers who require an Employee’s consent to obtain such information. Employees may not opt-out of the other personal information that has been provided to us by the Employee’s Employer. As set forth above, if an Employee seeks to have their personal, employment, or salary information removed from our system or their Employer’s records, or if Employee’s believe that their Employer has unlawfully retained or transmitted to us their personal, employment, or salary information, they must contact their Employer directly.

Where opt-out is possible, we provide email and telephone links, which will permit Employees to opt-out and the opportunity to contact our support team with questions or concerns.

Upon registration or from time-to-time, you may be asked to indicate whether you are interested in receiving information from us about special offers or news about our products, services, partners, and advertisers. You may also be provided with the opportunity to opt-in to receive offers directly from select companies other than EmpInfo. If you do choose to receive these communications by means of an opt-in, we will occasionally send you an e-mail message that matches your request(s). You may, of course, always choose not to receive any of this information from us. Software Demo Download and Email List

EmpInfo also collects personal information when a user requests to be added to our email list. The personal information we will collect for these services includes your name, email address, and online contact information. When the user requests to be added to the email list we will use the information collected to communicate with the user through email regarding products and services offered by EmpInfo.

With express approval and consent, EmpInfo may collect credit card information from Verifiers to process payment in connection with certain services that we offer. All credit card transactions will be securely processed and protected in accordance with the Payment Card Industry Data Security Standard (PCI DSS). PCI DSS is an information security standard for organizations that handle cardholder information for the major debit, credit, prepaid, e-purse, ATM, and POS cards. The standard was created to increase controls around cardholder data to reduce credit card fraud via its exposure. EmpInfo will use commercially reasonable efforts at all times to implement the standards articulated by PCI DSS, and will notify its customers in the event of a security breach, if notification is requested by emailing us at support@EmpInfo.com. By providing us with your credit card information, you agree to allow us to securely transmit the information provided to Authorize.net (“Authorize”), for the sole purpose of processing your credit card payment. Authorize will securely process your transaction under the PCI DSS.

We will never share your credit card information for our own marketing purposes or the marketing purposes of our affiliates, nor will we share information concerning your creditworthiness with any third party, unless expressly authorized or permitted by you or required by law.

Credit card information is used only for payment processing and fraud prevention. Credit card information and other sensitive personal information required to process a credit decision is not used for any other purpose by our financial services providers or EmpInfo and will not be kept longer than necessary for providing the services.

Under the Fair Credit Billing Act, your bank or credit card company cannot hold you liable for more than $50 of unauthorized or fraudulent charges on a credit card. Your liability for unauthorized use of a debit card may be higher, but most debit card issuers voluntarily apply the $50 limit to their cards as well. Remember: If unauthorized use of your credit or debit card does occur, you must notify your card provider, in accordance with the agreement you have with the company.
We may share a Verifier’s personal information, as permitted by law, with the bank or retailer whose name appears on your card.

Merger or Bankruptcy
If EmpInfo should ever file for bankruptcy or have its assets sold to or merge with another entity, information EmpInfo receives from you for this site and for the purpose of providing its services is an EmpInfo asset and may be transferred.

Linking and Third Party sites
Please note that EmpInfo is not responsible for the content or the privacy policies of websites to which our website may link. Our privacy policy does not apply to the policies and practices of companies that EmpInfo does not own or control, or to people that EmpInfo does not employ or manage.

Changes and Updates
We may occasionally update this Privacy Policy. When we do, we will also revise the “last updated” date on the Privacy Policy.
